Article 7, Section 9 of the Master Covenants states the Association may assess a late fee for any past due amount of quarterly dues.
Effect of Nonpayment of Assessments; Remedies of the Association. All Association assessments shall be past due if not paid within thirty (30) days from the invoice date. The Association may assess a late fee of $25.00 in the event an Owner’s account becomes sixty (60) days past due. Also, any assessment not paid within thirty (30) days after the due date may bear interest from the due date at a lesser of eighteen percent (18%) per annum, or maximum interest rate allowed by law. The Association may bring an action at law against the Owner personally obligated to pay the same, or foreclose the lien against the Lot, Unit, or Parcel, or both. No Owner may waive or otherwise escape liability for the assessments provided for herein by non-use of the Common Areas, or abandonment of such owner’s Lot, Unit, or Parcel. If an Owner is more than ninety (90) days delinquent in paying an assessment, the Association may suspend the rights of the Owner, or the Owner’s tenant, guest, or invitee, to use the common areas, facilities and vehicle transponders until the assessment is paid in full.
